Terms & Conditions
Definitions:
‘Company’ and ‘Seller’ means Design Di Lusso Ltd known hereinafter as ‘DDL Tiles’ or as ‘DDL’.
‘Buyer’ and ‘Customer’ means the person who accepts a quotation from the Seller, for the sale of
Goods or agrees to buy the Goods from the Seller.
‘Goods’ means the Tiles and other products which the buyer agrees to purchase from the Seller.
‘Order’ means the Order for the sale and purchase of the Goods between the Buyer and the Seller.
‘Price’ means the price for the Goods excluding where applicable, carriage, packaging, insurance and
Value Added Tax.
‘In Writing’ means communication by postal letter, email and any other comparable means of
communication.
The headings in these Conditions are for convenience only and shall not affect their interpretation.
Samples:
Tiles are subject to batch variations and any samples of tiles are subject to variation in shade, pattern,
design and tone. These variations are outside the control of DDL Tiles and the customer should keep
in mind that samples are only to give an indication of the product and may vary in shade, pattern,
design, tone and texture from actual full-size tiles when ordered.
If a full-sized sample has been purchased and breaks or is damaged in the care of the customer, DDL
Tiles will not be held liable and will not be held responsible to offer any replacement or refund.
Pricing:
DDL’s catalogues, price list, website and other advertising material shall not form any part of any
contract between the Buyer and the DDL Tiles.
Any information or description of the goods appearing in the DDL catalogues, brochures and other
publications is believed to be correct and current, but is not warranted by DDL Tiles, in so far as any
such publication has been compiled from information supplied to DDL Tiles, either by the
manufacturer or supplier of the goods. DDL Tiles will accept no responsibility for the accuracy of any
such information or description.
Unless otherwise stated in writing all prices quoted are exclusive of VAT. Quotations are valid for 30
Days from date of issue.
Prices are subject to alteration without prior notification and shall not be binding on DDL Tiles.
Ordering:
Orders are accepted and estimates for delivery are given conditionally upon DDL Tiles being able to
secure the necessary materials and /or goods and without responsibility for delays arising through
risks and uncertainties of manufacture, strike, accidents, or other causes beyond our direct control.
Payment for the goods either in full or in part by way of deposit shall in itself constitute an acceptance
of an agreement to these general Terms & Conditions.
Orders for non-stock/special orders will not be considered as accepted or placed until a minimum of
50% deposit has been received. Goods must be paid for in full before delivery/collection can be
arranged and any goods which are non-stock/special orders must be paid for in full within 48 hours of
the buyer being notified that the goods are now in stock with us.
Whilst DDL Tiles are happy to assist in calculating quantities we recommend the customer gets these
checked by their tiler/builder before placing any orders. It is the customer’s responsibility to ensure
the quantity ordered is correct before placing any orders.
DDL Tiles reserves the right not to supply the customer at the sole discretion of DDL Tiles.
Description of Goods:
All images, descriptive matter, specifications and advertising on our website or any other form of
publication are for the sole purpose of giving an approximate description of the goods.
All specifications given to the customer are approximate and intended as a guide only. DDL Tiles always
endeavour to ensure all product descriptions are correct, but advise customers to seek technical
advice from qualified sources prior to ordering products and prior to any work being carried out.
Product Quality / Warranty:
The supply of goods does not mean that they are suitable for a specific installation. DDL Tiles can only
be held responsible for any failure against products supplied, to the extent that the manufacturer of
such products is prepared to guarantee the same. No tiles are guaranteed against crazing.
Some variations in size, shape, manufacturing tolerance, shading and pattern are inherent in the
manufacture of tiles and therefore DDL Tiles will accept no liability for such variations. All Natural
Stone and ceramic products are supplied subject to natural colour and shade variations.
Where a significant area is to be tiled, it is the responsibility of the Tiler or Tradesperson to use where
possible, goods from a variety of separate boxes of tiles to ensure that any batch, colour, shading and
quality variances are minimised. Once the products are installed/laid, DDL Tiles will not be responsible
for any defects/damages/batch variations on the goods.
Any fault, quality or shading issue with the tiles supplied will remain the responsibility of the
manufacturer. DDL Tiles will accept no responsibility for further or subsequent loss or expense, if the
tiles are faulty, or not to the acceptance of the customer. Any such issues will be passed to the
manufacturers, whereby any claims will become solely the manufacturer’s liability, disclaimers or
notes printed on boxes or packaging will become the responsibility of the customer to read and accept,
prior to use or fixing.
Any claim by the customer, which is based on any defect in the quality or condition of the goods, or
their failure to correspond with specification, shall (whether or not the delivery is refused, by the
customer) be expected to notify DDL Tiles in writing by email to admin@ddl-tiles.com with
photographic evidence, within 48 hours of delivery.
Where there is a valid claim in respect of any defect in the quality or condition of the goods in
accordance with these conditions, DDL Tiles shall be entitled to replace the goods (or the part under
query) free of charge or at DDL’s sole discretion, refund to the customer the price of the goods (or a
proportionate part of the price) however, DDL Tiles will have no further liability to the customer.
DDL Tiles will not accept liability on advice given by sales personnel.
This policy does not affect your statutory rights.
Delivery:
DDL Tiles makes every effort to ensure goods arrive and are delivered by the estimated dates given at
the time of placing an order however these are only estimates based on many other variables outside
of our direct control. DDL Tiles do not accept responsibility for any delay, cost, or consequential loss,
how so ever caused by a failed or late delivery and will not entertain any financial demands from the
customer. DDL Tiles respectfully recommends that the customer does not book a Tiler or Tradesman,
until the goods have been delivered, signed for and quality checked. The risk in relation to the goods
passes to the customer at the point of physical delivery, at the time of delivery.
DDL Tiles reserve the right to utilise a variety of transportation services to deliver the goods to site.
For the purpose of general appreciation/association, the vehicle making the delivery is likely in most
cases, to be the comparative size of a Fire Engine, or slightly larger. It is the customer’s responsibility
to notify DDL Tiles of any circumstances that may affect the delivery of goods using a vehicle of this
size, i.e. Parking restrictions, “Red Routes”, Vehicle access due to height or width, Narrow roads, Road
works, Gravel or uneven driveways, Building sites, High rise apartments (with or without lifts) etc.
Failure to communicate relevant information to DDL Tiles prior to delivery may result in additional
costs for the re-supply being incurred by the customer and may also increase the re-delivery lead time.
The delivery driver cannot help with moving the products inside the delivery site, the load will be
dropped at the nearest convenient point to the site, which could be the roadside. Every effort will be
made to deliver to the desired and requested point of delivery however, in circumstances where it is
not practical or possible to complete the delivery goods will be returned to DDL Tiles and classed as
failed delivery. Any additional costs incurred by DDL Tiles for failed deliveries are charged to the
customer and deliveries will be rescheduled once the full payment is made. Anything the customer
can do to help ensure the order can be dropped closer to the site is appreciated.
Smaller deliveries will be made on a courier’s transit van which will require people on site to offload
the goods from the vehicle. The customer will have 15 minutes to offload the goods from the vehicle.
It is the customer’s responsibility to offload the goods from the vehicle in a timely and efficient
manner. If additional costs are incurred during the offloading process (waiting time or assistance from
the driver) DDL Tiles reserves the right to charge the customer for the additional costs incurred.
Please make sure that when delivery has been made all products are checked and delivery notes are
signed. DDL Tiles will not accept any claims if delivery notes are signed as ‘UNCHECKED’. If the
customer has asked someone else to receive the delivery on their behalf, they must be thoroughly
informed of these conditions.
Damaged/Incorrect Goods:
All goods must be checked by the customer or their representative as soon as possible on receipt of
goods – this is imperative. No responsibility for damages, shortages or incorrect products can be
accepted after 48 hours of receipt of goods. Any damaged or incorrect goods must be reported to
DDL Tiles within the 48-hour timeframe by email to admin@ddl-tiles.com and the email must include
photographic images of the damaged goods.
Where you purchase goods from DDL Tiles that are defective or damaged, DDL Tiles shall (at their
discretion) exchange such goods or refund the price of such goods, provided that: (a) the customer
gives DDL Tiles notice within 48 hours of the date of the delivery to the customer and (b) provided
that damage to the goods has not been caused by the customer.
Once the products are installed/laid, DDL Tiles will not be responsible for any defects/damages/batch
variations on the goods. Goods should not be used/installed unless the buyer is completely satisfied
with the product.
DDL Tiles entire liability to the customer shall be limited to the price the customer paid for the goods
and DDL Tiles shall not be responsible for any consequential or other financial loss that the customer
may seek to claim for.
All damaged goods will be replaced on standard delivery at DDL’s cost either by delivering direct to
DDL Tiles showroom (if goods were originally collected from store) or having another delivery sent out
(if goods were originally delivered to site).
Collecting goods:
Customers collecting their goods from DDL Tiles showroom, must ensure that the goods are not
broken or damaged upon collection and therefore assume full responsibility for the goods once they
have been loaded into the Customer’s (or nominated person’s) vehicle. DDL Tiles will not be
responsible for any damages discovered to goods once they have left the warehouse.
Special Orders:
All non-stock items are considered special order items. Special order items are non-refundable and
non-exchangeable. Special order items cannot be cancelled once ordered with DDL Tiles suppliers and
deposit payments made are non-refundable on special order items.
Storing/Holding Orders:
DDL Tiles can hold/store orders ready for delivery for up to 14 days from the date all goods are
received and ready for collection/delivery and the customer notified. Any period longer than this is
chargeable at a rate of £10.00 +vat per pallet per day and payable before collection/delivery can be
organised.
Cancelations/Returns:
Stock Items can be cancelled at any point before dispatch. Non-stock items or special ordered items
cannot be cancelled once orders have been placed with suppliers.
Stock items can be returned for full refund within 14 days of receipt of goods providing they are in
original unopened packaging and deemed to be in a sellable condition by DDL Tiles.
